Terms of Service

These terms are the agreement between you and DNAGroup SRL (DNAFactory) for using Aura: the website, the apps, live battles, solo lives, clips and the virtual currency called aura. Please read them carefully: by creating an account you accept them.

1. Who we are

Aura is a service provided by DNAGroup SRL (registered office: Via dei Mille 40, 80121 Naples, Italy; operating office: Via Lucullo 71, 80070 Bacoli (NA), Italy; VAT no. IT08925651211; share capital €11,600 fully paid; SDI code M5UXCR1), an Italian company operating under the DNAFactory brand ("we", "us"). 2. Your account

  • You must be at least 16 years old to create an account.
  • You must give true information, keep your password secret and are responsible for everything done with your account. We recommend turning on two-factor authentication.
  • One person, one account: you may not create accounts to manipulate battles, reports or the leaderboard.
  • You can sign up with email and password or with Apple, Google or Facebook.
  • When you create an account, and every time we publish a new version of these Terms or of the Privacy Policy, we ask you to accept them. We log each acceptance with the date, the version, your IP address and device. If you do not accept a new version you may not continue using the service, but you can still delete your account.

3. The service

Aura lets you watch and join live battles between squads (1v1, 2v2, 4v4), go live on your own, publish short clips, comment, follow creators and support them with aura. Features may change over time; we may add, modify or remove features, and we will tell you in advance about changes that significantly affect you.

The service is provided "as is". We work to keep it available and secure, but we cannot guarantee that it will always be uninterrupted or free of errors.

4. Your content

You keep the rights to the content you publish (clips, lives, comments, profile). To operate Aura you grant us a non-exclusive, worldwide, royalty-free licence to host, store, transmit, display and adapt it (for example to transcode videos or create thumbnails), for as long as the content is on Aura and for the time needed to remove it afterwards.

You confirm that you have all the rights needed for what you publish, including music and the image of the people who appear in it, and that it does not break the law or these terms.

5. Community rules

On Aura it is forbidden to publish or broadcast:

  • nudity, sexual content or any content that sexualises minors;
  • violence, threats, self-harm or dangerous challenges;
  • hate speech, discrimination, harassment or bullying;
  • scams, spam, misleading promotions or impersonation of other people;
  • illegal content or content that infringes the rights of others (copyright, privacy, image rights).

It is also forbidden to cheat in battles, use bots or several accounts, send aura to battles you play in or to your own lives, or attack the security of the service.

Aura has zero tolerance for objectionable content and abusive users. Offensive words are filtered automatically, you can block any user at any time from their profile, and our team reviews reports within 24 hours: we remove the content that breaks these rules and suspend or permanently ban the users who posted it.

Anyone can report content or users. Content with 10 reports is automatically hidden until our team reviews it; an account with 20 reports cannot publish until it is reviewed. We may remove content and suspend or close accounts that break these rules, and we will explain the reason. You can contest a decision by writing to [email protected].

6. Aura: the virtual currency

  • Aura is a virtual currency that can only be used inside Aura to support squads in battles and creators during lives, in mini-games and with profile gifts. It is not money: purchased aura is a limited, personal licence to use a feature of the service, has no monetary value outside Aura, cannot be converted into money or any other currency, cannot be transferred to other accounts except by sending gifts, and cannot be resold.
  • Free aura: every account with a verified email receives 1,000 free aura per day, which does not carry over and resets at midnight (Italian time). When you create your account you also receive a one-time welcome bonus of 20,000 free aura, which does not expire. Free aura is always spent before purchased aura: first the daily aura, then the welcome bonus.
  • Free aura can be sent like purchased aura and counts the same for scores and the leaderboard, but it never generates earnings for anyone and is never refunded or paid out.
  • Aura sent to a squad or a creator is added to their score immediately and cannot be taken back by the sender.
  • Creators collect the aura they receive to climb the leaderboard (section 10). Aura itself can never be converted into money; from Season 0 creators can accrue earnings as described in section 11.
  • We may correct balances affected by errors, fraud or abuse.

7. Buying aura

  • You can buy aura packs on the website, with payments processed by Stripe, or in the apps for iOS and Android, as consumable in-app purchases through the App Store (Apple) or Google Play (Google). For in-app purchases the store processes the payment under its own terms, and the price is the one shown by the store, in your local currency and with the taxes applied by the store. On the website prices are shown in euro and include VAT where applicable.
  • Aura bought is added to your account immediately after payment and is available on the website and in the apps with the same account.
  • Aura packs are consumable: they are used up as you spend the aura, so restoring purchases does not apply. Aura bought stays with the account that bought it, on every device where you sign in with that account.
  • Purchased aura is not refundable, except as described in section 8: where the law requires it, through the refund process of the store, or for unused website purchases.
  • Before paying you expressly ask for immediate delivery of the aura and acknowledge that you lose the 14-day right of withdrawal provided by EU consumer law once the aura has been delivered to your account (Art. 59(1)(o) of the Italian Consumer Code and Art. 16(m) of Directive 2011/83/EU).

8. Refunds

The refund rules depend on where you bought the aura:

  • Purchases on the website (Stripe): a refund must be requested only by opening a support ticket, from the support form with the topic "Refund request" or by writing to [email protected] from the email of your account, indicating the date of the purchase;
  • a purchase on the website can be refunded only if none of the aura in that purchase has been used. If you buy 1000 aura and send even 1 purchased aura, that purchase can no longer be refunded. The free daily aura does not count, because it is always spent first. When approved, the refund is made on the original payment method through Stripe and the aura of that purchase is removed from your balance;
  • Purchases in the apps (App Store / Google Play): the payment is handled by Apple or Google, so a refund must be requested directly from them, under their rules (for Apple at reportaproblem.apple.com, for Google from your Google Play order history): we cannot refund these purchases. If you gave your consent when buying, when Apple asks us about your refund request we tell Apple how much of the pack's aura you have already used and, if you have used part of it, that we prefer the refund not to be granted; the decision remains Apple's;
  • if a purchase is refunded, cancelled or reversed (a refund or revocation by Apple or Google, or a chargeback through your bank or card issuer), the aura of that pack is taken back from your account even if you have already used part of it: in that case your balance can become negative and aura you buy afterwards will first bring it back to zero. Earnings generated by that aura can also be cancelled (section 11);
  • deleting your account: aura already used is never refunded; if you have a purchase on the website that is completely unused, you must request the refund through support before deleting your account, because afterwards we can no longer verify it. For in-app purchases the rules of Apple and Google still apply.
  • This does not limit the rights you have by law in case of payment errors, double charges or services not delivered: in those cases write to us and we will fix it.

9. Gifts, gift messages and the end of a battle

During lives and battles you can send gifts, which cost aura and are added to the score of the squad or creator you support. Battle and live mini-games and gifts left on a profile cost aura in the same way.

  • Battles: at the end of a battle the aura sent to both squads goes to the winning squad, split among its members; in a draw each squad keeps the aura sent to it, split among its members. Members of the losing squad receive no aura from that battle.
  • Gift messages: when you send one of the four most expensive gifts during a live or a battle (currently Crown, Gem, Rocket and Aura Storm) you can attach a short text of up to 80 characters. The message is public: it is shown on screen, under the gift, to everyone watching. Messages are shown one at a time, in the order they were sent.
  • Gift messages must follow the community rules (section 5): no insults, harassment, hate, spam, advertising or personal data, yours or anyone else's. Messages are filtered automatically and we can remove them; abuse can lead to the suspension or closure of the account.
  • The last 30 seconds of a battle: in the final 30 seconds gifts and mini-games cannot be sent. Only the manual aura boost can be sent, and in that window it counts double (x2) for the battle score. The x2 doubles the battle points only, not the aura received or the earnings.

10. Seasons, rank points and leaderboard

Rank points (RP) measure your level in ranked battles: you win RP when your squad wins and lose them when it loses, depending on the level of the opponents.

  • Pre-season: at the moment there is no active season. During the pre-season ranked battles award and remove RP as usual.
  • Seasons: seasons, starting with Season 0, are started by us, each with a set duration that we announce in the service. When a season starts, every user's RP are reset to the starting value.
  • Between two seasons RP are frozen: you can still play battles, but you cannot win or lose RP until the next season starts.
  • Aura leaderboard: during the pre-season the aura received keeps adding up. When Season 0 starts, the received-aura totals used by the leaderboard are reset to zero, once; from Season 0 on they are never reset again, not even when later seasons start.

11. Creator earnings

From the start of Season 0, creators accrue earnings equal to 10% of the monetary value of the purchased aura they receive: gifts during lives and battles, battle and live mini-games, and profile gifts. There are no earnings before Season 0: aura received earlier generates none.

  • Value of aura: aura is worth what the sender actually paid for it, based on the price of the aura packs they bought. For example, 1,000 aura from the pack of 1,000 aura at €0.99 give €0.099 of earnings, and 70,000 aura from the pack of 70,000 aura at €49.99 give €4.999. Amounts are shown rounded down to the cent.
  • Only purchased aura counts: the free daily aura and the welcome bonus never generate earnings.
  • The x2 does not count: the multiplier of the last 30 seconds of a battle doubles the battle points, not the earnings.
  • Battles: earnings follow the aura, so they go to the winning squad split among its members (in a draw each squad keeps its own). Members of the losing squad receive neither aura nor earnings from that battle.
  • Where you see them: earnings are shown in euro in your account, under Earnings.
  • Payouts are not active yet: they will be governed by separate terms, announced before they are activated, which will include identity and tax checks and minimum thresholds. Until then earnings cannot be withdrawn.
  • We may withhold or cancel earnings linked to fraud, to refunded, cancelled or charged-back purchases, or to violations of these terms.

12. Suspension and closing the account

You can delete your account at any time from the settings. We may suspend or close accounts that seriously or repeatedly break these terms, the law or the rights of others, or to protect the security of users. In case of closure for violations, the remaining aura is lost and is not refunded, except where the law requires otherwise. Earnings linked to the violations can be cancelled (section 11).

13. Liability

Users are responsible for the content they publish and broadcast. We are not liable for the content of users, but we act promptly to remove illegal content when we become aware of it. Nothing in these terms limits our liability where the law does not allow it, for example for wilful misconduct or gross negligence, or your rights as a consumer.

14. Changes to these terms

We may update these terms, for example for new features or legal requirements. For material changes we will ask you to read and accept the new version the next time you use Aura; the date of the current version is shown at the top of this page.

15. Applicable law and disputes

These terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you can bring a claim before the courts of your place of residence.
